DECISION and ORDER: IT IS ORDERED that 1. The University's motion to dismiss (Dkt. No. 5) is DENIED as moot; 2. Plaintiff's cross-motion to amend (Dkt. No. 12) is GRANTED; 3. Plaintiff's proposed amended complaint (Dkt No. 12-1) is ACCEPTED FOR FILING by the clerk of the Court; and 4. Defendants CCE Delaware and the University shall answer the amended pleading within 14 days of the date of this decision. The Clerk of the Court is directed to: a. Docket the non-redlined version of plaintiff's proposed amended pleading as the operative complaint in this action; b. terminate the pending motions (Dkt.
