1. Parties and Agreement
These Terms of Service ("Terms") constitute a binding agreement between you ("User," "you," or "your") and GavelSight LLC, a limited liability company ("GavelSight," "we," "us," or "our"). By creating an account, clicking "I agree," or using any GavelSight service, you accept these Terms in full. If you are accepting on behalf of a law firm or organization, you represent that you have authority to bind that entity.
2. Description of Service
GavelSight is a paid judge intelligence platform that provides:
- Searchable federal judge profiles, published opinions, and citation analytics derived from official public court records
- State court judge profiles and analytics (available as add-on coverage)
- AI-assisted legal research tools (opinion search, research memos, citation checking) grounded in the underlying opinion corpus
- Aggregated analysis and reporting of a judge’s published opinions and the authorities they cite
- Exportable PDF reports for litigation preparation
GavelSight aggregates and analyzes the public record. It does not predict case outcomes, guarantee results, or represent how any judge will rule in any matter. All analytics describe historical published opinions, not future behavior.
GavelSight is available to users in the United States only. The service is intended for use by licensed attorneys, paralegals operating under attorney supervision, and legal professionals at law firms, corporations, and government entities. GavelSight is a paid subscription service.
3. Work Product and Privilege
Outputs generated through GavelSight may qualify as attorney work product when used by licensed attorneys in the course of legal representation, depending on the circumstances of use and applicable law. GavelSight makes no representation or guarantee that any output will be afforded work product protection in any particular jurisdiction or proceeding. Users are solely responsible for asserting and protecting any applicable privilege or protection.
GavelSight outputs do not constitute legal advice. They are analytical tools to assist attorneys in forming independent professional judgments. No attorney-client relationship arises from the use of this service.
3A. Third-Party Services and Sub-Processors
Certain GavelSight features depend on third-party service providers. When you use a feature that relies on a third-party provider, your use of that feature is also subject to that provider’s applicable terms and privacy policy, which are incorporated by reference into these Terms solely in the context of, and to the extent applicable to, that feature. GavelSight does not control these providers and is not responsible for their acts, omissions, availability, or changes to their services or terms. The current providers are:
- AI-assisted features (Judge Chat, AI Paralegal — research memos, authority finder, citation checking, document drafting). These features send your queries and relevant excerpts of the opinion corpus to a third-party large-language-model provider (currently OpenRouter, Inc. and the underlying model provider Anthropic, PBC) to generate responses. Use of these features is subject to those providers’ terms and privacy/data-handling policies. GavelSight directs these providers not to train on your data where such a setting is available, but GavelSight does not warrant any provider’s data practices. Do not submit information through AI features that you are not authorized to disclose to a third-party processor.
- Payments and billing. Subscription payments are processed by Stripe, Inc. GavelSight does not store full payment-card numbers; card data is handled by Stripe under Stripe’s Services Agreement and Privacy Policy. Your purchase is subject to those terms.
- Email and notifications. Transactional email (receipts, account and billing notices) is delivered through Resend, Inc. and is subject to Resend’s terms and privacy policy.
- Hosting and error monitoring. The service is hosted on third-party cloud infrastructure and may use third-party error-monitoring tooling to maintain reliability; these providers process operational data subject to their respective terms.
GavelSight may change, add, or remove third-party providers at any time. The provider list above reflects providers in use as of the last update to these Terms. You are responsible for reviewing the linked providers’ current terms before using the features that rely on them.
4. Data Sources and Attribution
Judicial data is compiled from public federal-court sources, including govinfo.gov (the U.S. Government Publishing Office) for federal opinions, each state's official court reporter for state opinions, and the Federal Judicial Center biographical directory. We do not use commercial aggregators. GavelSight is not affiliated with, endorsed by, or sponsored by any of these source operators, the federal judiciary, or any government agency. All federal court opinions, biographical records, and docket data referenced are public records under applicable law.
5. User Responsibilities and Uploaded Content
When you submit case facts, litigation summaries, or other materials to GavelSight ("User Content"), you represent and warrant that:
- You have the authority to submit such materials and to grant GavelSight the right to process them to deliver the service
- The submission does not violate any court order, confidentiality obligation, or applicable law
- You are responsible for ensuring that submission of client information complies with your professional responsibility obligations, including applicable rules of professional conduct
GavelSight processes User Content solely to deliver the requested analysis. You retain ownership of your User Content.
6. Subscription Terms and Billing
GavelSight offers the following subscription plans (prices in USD, per seat per month):
- Essentials: $99/seat/month — access to judge analytics, predictions, and standard reports (50 predictions per day)
- Pro: $199/seat/month — unlimited predictions, firm accounts, SSO, advanced reports, and priority access
- Firm: $799/month — 5 Pro seats included, single bill, add seats at $159/seat/month
- Enterprise: custom pricing — contact hello@gavelsight.com
Auto-Renewal: Subscriptions renew automatically at the end of each billing period unless cancelled. You authorize GavelSight to charge your payment method on file for each renewal period.
Cancellation: You may cancel your subscription at any time through your account settings or by contacting hello@gavelsight.com. Cancellation takes effect at the end of the current billing period. No partial-period refunds are issued except where required by law.
Refunds: GavelSight does not issue refunds for subscription fees already paid, except (a) where required by applicable law or (b) at GavelSight's sole discretion in response to a written support request within 7 days of the initial charge for that billing period.
Taxes: Subscription prices are exclusive of applicable taxes. You are responsible for all taxes, levies, or duties imposed by taxing authorities in connection with your use of GavelSight.
Price Changes: GavelSight may change subscription pricing upon at least 30 days' written notice to the email address on your account. Continued use after the price change takes effect constitutes acceptance of the new price.
7. Intellectual Property
GavelSight LLC owns all rights in the GavelSight platform, including its software, algorithms, predictive models, trade dress, trademarks, and aggregated or derived analytical outputs. These Terms do not grant you any rights in GavelSight's intellectual property other than the limited right to access and use the service as described herein. You may not scrape, reverse-engineer, resell, sublicense, or create derivative works from GavelSight outputs without prior written consent.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GAVELSIGHT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR LITIGATION LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF GAVELSIGHT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. GAVELSIGHT'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO GAVELSIGHT IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, GavelSight's liability is limited to the greatest extent permitted by law.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. GAVELSIGHT DOES NOT WARRANT THAT JUDICIAL ANALYTICS OR PREDICTIONS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR LITIGATION MATTER.
10. Termination
GavelSight may suspend or terminate your account at any time for violation of these Terms, non-payment, or any conduct that GavelSight reasonably determines to be harmful to the service or other users. You may terminate your account at any time by contacting support. Upon termination, your right to access the service ceases immediately. Sections 3, 7, 8, 9, 11, and 12 survive termination.
11. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising from or relating to these Terms or the GavelSight service shall be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.
12. General Provisions
These Terms constitute the entire agreement between you and GavelSight LLC with respect to the service and supersede any prior agreements. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. GavelSight's failure to enforce any provision shall not constitute a waiver. GavelSight may update these Terms from time to time; continued use after notice of an update constitutes acceptance.
13. Venue Analysis and County-Level Coverage
Venue Analysis Disclaimer. GavelSight's venue analysis feature provides ranked results across counties and jurisdictions based on available judge tendency data. Venue analysis outputs are informational only and do not constitute legal advice or a recommendation to file in any particular jurisdiction. Forum shopping strategies carry professional responsibility implications. Users are solely responsible for ensuring that any venue selection decision complies with applicable rules of professional conduct, court rules, and applicable law. GavelSight makes no representation that any venue analysis output is complete, current, or suitable for any specific matter.
County-Level Coverage Accuracy. GavelSight publishes honest coverage grades for all counties and jurisdictions it tracks. Counties showing "Data Pending" have court structure recorded but no judge profiles. Counties with grade C have judge records but limited tendency data. Grades A and B indicate judge profiles with tendency data and are distinguished by data recency. GavelSight does not inflate coverage grades. Users should independently verify data completeness for any jurisdiction material to a specific litigation matter.
State and County Data Sources. State court judge profiles and county-level data are derived from publicly available state court records, state court websites, and licensed data providers. GavelSight is not affiliated with any state court system. State court data may be less complete or less frequently updated than federal court data. Coverage availability for any specific county or state may change without notice as data pipelines are updated or expanded.
