THIS CAUSE is before the Court upon Plaintiff Glitch Productions Pty Ltd's (Cûplaintiff '
or (tGlitch'') Motiqn for Entl-y of a Preliminary Injunction. ECF No. (171 .
In the Motion, Glitch seeks entl'y of a preliminal-y injunction order against the Partnerships
and Unincorporated Associations Identified on Schedule A hereto (collectively, GsDefendants'),
and ently of an order restraining the financial accounts used by Defendants, pursuant to the
Lallham Act, 15 U.S.C. jj 1 1 16 et seq.k Federal Rule of Civil Procedure 65; the Copyright Act,
The Coul't previously entered an order granting Plaintiff s ex parte Motion for Entl'y of
Temporary Restraining Order (CtTRO''). ECF No. (1 11. The Cou14 convened a public hearing on

Gliteh alleges that Defendants, through fully interactive, e-commerce storesl , operating
under the seller aliases identified on Schedule A to the Complaint and attached hereto (the dsseller
Aliases''), have advertised, promoted, offered for sale, sold, or impol-ted goods bearing and/or
embodying what Glitch has determined to be counterfeits, infringements, reproductions, or
colorable imitations of the MD Trademarks and/or unauthorized copies of the MD Copyrighted
Works. ECF No. (11.
Glitch alleges that it has not licensed or authorized Defendants to use any of the MD
Trademarks or MD Copyrighted W orks, and none of the Defendants are authorized retailers èf
genuine Glitch Products. See ECF No. (8-1) ! 21 .
Glitch attests that it investigated the promotion and sale of infringing and counterfeit
versions of its branded products by Defendants (Ccunauthorized Products''). See id. at ! 19. Glitch

alleges that it analyzed each of the e-commerce stol'es operating under the Seller Aliases and
determined that Unauthorized Prodtlcts were being offered for sale to residents of the United
States, including Florida. 1cl ln addition, each e-commerce store offered shipping to Florida. 1d.
Glitch attests that it conducted a review and visually inspected the Unauthorized Products liited
for sale on each Defendants' e-commerce store and deterlnined said products were non-genuine
and unauthorized by Glitch. 1d.
1I. LEGAL STANDARD
To obtain a preliminal'y injunction, a party must demonstrate'. (1) a substantial likelihood
of success on the merits; (2) that irreparable injury will be iuffered if the relief is not granted; (3)
that the threatened injuly outweighs the harm the relief Fould inflict on the non-movant; and (4.)
that the entry of the relief would serve the pubiic interest. Schiavo ex rp/. Schindler v. Schiavo,
51 F.3d 982, 985 (1 lth Cir. 1 995) (applying the test to a preliminal-y injunction in a Lanham Act
case).
111. CONCLUSIONS OF LAW
Glitch's Motion supports the following conclusions of law:
Glitch has a strong probability of proving at trial that consumers are likely to be
confused by Defendants' advel-tisement, promotion, sale, offer for sale, and/or
distribution of Unauthorized Products, and that Defendants' Unauthorized Products use
infringing and countelfeit versions of the MD Trademarks and/or unauthorized copies
of the MD Copyrighted Works.
B. This Cou14 has personal jurisdiction over Defendants because Defendants directly
target their business activities toward consumers in the United States, including Florida.

Specifically, Defendants have targeted sales to Florida residçnts by setting up and
operating e-commerce stores that target United States consumers using the Seller
Aliases, offer shipping to Florida, and/or have sold Unauthorized Products to residents
of Florida.
Because of the infringement of the MD Trademarks and/or MD Copyyighted Works,
Glitch is likely to suffer imluediate and il-reparable i. njury if a preliminary injunction
order is not granted. The following specific facts, as set forth in Glitch's Complaint,
Glitch's Motion, and acqompanying declarations, demonstrate that ilnmediate and
irreparable loss, damage, and injury will result to Glitch and to consumers before
Defendants can be heard in opposition unless Glitch's request for preliminal-y relief is
granted:
Defendants own, operate, and/or control fully interactive, e-commerce stores
operating under the Seller Aliases which advellise, offer for sale, sell, and ship
Unauthorized Prodtlcts to customers in Florida that bear infringing and/or
counterfeit versions of the MD Trademarks and/or bear tlnauthorized copies of
the MD Copyrighted Works; and
There is good cause to believe that more counterfeit and infringing products
bearing the MD Trademarks and/or unauthorized copies of the MD Copyrighted
Works will appear in the lnarketplace; that .consumers are likely to be misled,
confused, and éisappointed by the quality of the Unauthorized Products', and
that Glitch may suffer loss of sales for its gentline prodtlcts and an unnatural
erosion of the legitiluate marketplace in which it operates', and

The potential harm to Defendants in restraining their trade in counterfeit and infringipg

goods through their e-cormperce stores and freezing ill-gotten profits if a preliminar'y
injunction order is granted is far otltweighed by the in'eparable harm Glitch?. its
reputation, and its goodwill has suffered and will continue to suffer if a preliminary
injunction order is not issued.
The public interest favors issuance of the preliminal-y injunction order to prevent
consumer confusion and dispel the false impression that Defendants are operating their
e-commerce stores with Glitch's approval and endoà-sement, as wqll as protect Glitch's
legitimate intellectual property interests. Further, the public will be protected from
being defrauded by the illegal sale of Unauthorized Products.
Under 1 5 U.S.C. j 1 1 17(a), Glitch may be entitled tp recover, as an equitable remedy,
the illegal profits gained through Defend.ants' distribution aln:d sales of goods bearing
infringing and/or cotlnterfeit versions of the MD Trademarks. See Reebok Int'l, L td. v.
Marnatech Enters., Inc., 970 F.2d 552, 559 (9th Cir. 1992) (quoting Fuller Brush
Prods. Co. v. Fuller frt/s'/c Co., 299 F.2d 772, 777 (7th Cir. 1962)) ((ûAn accounting of
profits under j 1 1 17(a) is not synonymous with an award of monetary daluages: & gajn
accounting for profits . . . is an equitable remedy subject to the principles of equity''').
Under 17 U.S.C. j 504(b) and 17 U.S.C. j 502(a), Olitch may be entitled to recover,
as an equitable remedy, the illegal profits gained tlu'ough Defendants' distribution and
sales of goods bearing unatlthorized copies of the MD Copyrighted W orks. See Antsy
Labs, LLC v. lndividuals, 24-cv-61436-WPD, 2024 WL 4472009, at *2 (S.D. Fla. Sept.
16, 2024) (tûunder 17 U.S. Code j 504(b) and 17 U.S. Code j 502(a), Plaintiff may be

entitled to recover, as an eqtlitable remedy, the illegalprofits gained through
Defendants' distribution and sales of goods infringing Plaintiff s Copyrights.'').
Reqtlesting eqtlitable relief ttinvokes the district court's inherent equitable powers to
order preliminal'y relief, including an asset freeze, in order to assure the availability of

(abrogated on other groundsp).
In light of the inherently deceptive nattlre of the intellectual property infringement
business, and the likelihood that Defendants have violated federal trademark and
. 'd
copyright laws, Glitch has good reajon to believe Defendants will hide or transfer their
ill-gotten assets beyond the jtlrisdiction of this Court unless those assets are restrained.
Accordingly, upon due consideration of Glitch's Colpplaint, the Motion, the supportipg
evidentiary submissions, the relevant authol-ities, and for the reasons set forth on the record at the
hearing on the Motion, which are incorporated herein, it is hereby ORDERED AND ADJUDGED
that the Motion, ECF No. g17q, is GRANTED, under the terms set fol'th below:
Defendants, their affiliates, officers, agents, servants, employees, attorneys, confederates,
and a11 persons acting for, with, by, tlu'ough, under, or in active concert with Defendants
be preliminaly enj oined and restrained from:
a. using the MD Trademarks or any reproductions, counterfeit copies, or colorable
imitations thereof in any manner in connection with the distl-ibution, marketing,
advel4ising, offering for sale, or sale of any product that is not a genuine Glitch product
or not authorized by Glitch to be sold in colmection with the MD Trademarks;

Glitch product or any other product produced by Glitch, that is not Glitqh'y o!- not
produced under the atlthorization, control, or supelwision of Glitch and approved by

Glitch for sale under the MD Trademarks and/or MD Copyrighted Works;
d. committing any acts calculAted to cause consumers to believe that Defendants' products
are those sold under the authorization, control, or supervision of Glitch, or are
sponsored by, approved by, or otherwise connected with Glitch;
further infringing the MD Trademarksand MD Copyrighted .W orks and dqmaging
Glitch's goodwill; and
f. mantlfacturing, shipping, delivering, holding for sale, transfen-ing or otherwise mpving,

storing, distributing, returning, or otherwise disposing of, in any manner, products or
inventory not manufactured by or for Glitch, nor authorized by Glitch to be sold or
offered for sale, and which bear any of Glitch's tradel-narks, including the MD
Trademarlts, or any l'eproductions, cotmterfeit copies, o1' colorable imitations and/or
which bear the MD Copyrighted W orks.
Upon Glitch's request, any third pa14y with actual notice of this Order who is providing
services for any of the Defendants, or in connection with any of Defendants' Seller Aliases,
including, without limitation, any online platforms such AliExpress.com

the nature of Defendants' operations and a11 associated sales, methods of payment for

infonuation associated with the Seller Aliases and Defendants' financial accounts? as
well as providing a full accounting of Defendants' sales and listing history related to
their respective Seller Aliases; and
c. any financial accotlnts owned or controlled by Defendants, including their agents,
servants, employees, confederates, attolmeys, and any persons acting in concel't or
participation with them, including sklqh accotlnts residing with or under the control of
any banks, savings and loan associations, payment processors or other financial
instittltions, including, without limitation, the AliExpress, Alipay, Amazon, Amazon
Pay, Dl-lGate, eBay, Payoneel' Global, lnc. (tûpayoneer'') Paypal, lnc. (($PayPa1'')) l
SHEIN, Stripe, lnc. ($CStripe''), Walmal't, and Wish, or other merchant account
providers, payment providers, third pal4y processors, and credit card associations (e.g.,
Mastercard and VISA).
Upon Glitch's request, those with notice of this Order, including the Third Pal4y Providers
as defined in Paragraph 2, shall within seven (7) calendar days after receipt of such notice,
disable and cease displaying any advertiseluents used by or associated with Defendants in

connection with the sale of counterfeit and infringing goods using the MD Trademarks
and/or which bear the MD Copyrighted Works.
Defendants shall be temporarily and preliminarily restrained and enjoined from
transferring or d. isposing of any money or other of Defepdants' assets until ftèrther ordered
by this Court.
Any Third Pgrty Providers, including AliExpress, Alipay, Amazon, Amazon Pay, Dl-lGate,
eBay, Payoneer, Paypal, SHEIN,Stripe, Walmal-t, and Wishshall, within seven (7)
calendar days of receipt of this Order'.

a. the identities and locations of Defendants, their affiliates, officers, agents, servants,
employees, confederates, attorneys, and any persons acting in active concert or
participation with them, including a11 known contact information, including any and al1
associated e-mail addressess' and
the nature of Defendants' operations and a11 associated sales, methods of paylnent for
services, and financial infonuation, including, without limitation, identifying
information associated with the Seller Aliases and Defendants' financial accotlnts, as

well as providing full accounting of Defendants' sales and listing histol'y related to their
respective Seller Aliases.
Glitch is authorized to issue the expedited discovery requests authorized in Paragraph 6 via
e-mail. Defendants shall respond to any such discovery requests within three (3) business
days of being served via e-mail.
Any Defendants that are subject to this Order may appear and move to dissolve or modify
the Order as penuitted by and in compliance with the Federal Rules of Civil Procedure and
Southelm District of Florida Local Rules.
The ten-thousand-dollar ($10,000) bond posted by Plaintiff shalt remain with the Cou14
