FINNEGAN, Circuit Judge (concurring) . This separate opinion serves as a reservation of my views concerning those provisions of the Internal Revenue Code of 1954 mentioned in Judge HASTINGS’ opinion. My brothers reached a result under the Internal Revenue Code of 1939 which I approve.
