Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the GavelSight website, applications, and services (collectively, the “Service”), operated by GavelSight LLC, a Florida limited liability company (“GavelSight,” “we,” “us”). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

GavelSight is not a law firm and does not provide legal advice. The Service is an analytics and information tool. Nothing in the Service constitutes legal advice, creates an attorney–client relationship, or substitutes for the independent professional judgment of a licensed attorney. Judicial analytics describe historical patterns in the public record and do not predict, guarantee, or warrant the outcome of any case, motion, or proceeding. You are solely responsible for all legal decisions and for independently verifying any information before relying on it.

1. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a law firm, organization, or other entity, you represent that you are authorized to bind that entity to these Terms, and “you” refers to that entity.

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Subscriptions are licensed on a per-seat basis; each seat is for a single named individual and may not be shared, resold, or accessed by more users than the number of seats you have purchased. Notify us promptly of any unauthorized use.

2. The Service

GavelSight provides structured analytics, tendency analysis, and probabilistic estimates derived from public court records, including data made available through the Free Law Project’s CourtListener and related public sources. Judge profiles and predictions are labeled within the product to indicate whether they are built on curated baseline data or live-synced data. See our methodology for details on data sources, classification, and statistical thresholds.

We do not warrant that the data is complete, current, error-free, or suitable for any particular case. Court records may contain omissions, delays, or inaccuracies outside our control. Predictions are statistical estimates based on historical patterns; past patterns do not guarantee future judicial behavior.

3. Acceptable Use

You agree not to: (a) scrape, crawl, bulk-download, or systematically extract data from the Service except through features we expressly provide; (b) resell, sublicense, or redistribute the Service or its output except as permitted in writing; (c) reverse engineer or attempt to derive source code or models; (d) use the Service to harass, threaten, or intimidate any judge, court official, party, or other person; (e) use the Service in violation of any applicable law, court rule, rule of professional conduct, or attorney-advertising regulation; or (f) interfere with the security or integrity of the Service. You are solely responsible for ensuring your use complies with the rules of professional responsibility and bar regulations in every jurisdiction in which you practice.

4. Subscriptions, Billing, and Renewal

Paid subscriptions are billed in advance on a recurring monthly or annual basis, per seat, at the rates shown at checkout, plus applicable taxes. Subscriptions automatically renew at the end of each billing period at the then-current rate unless you cancel before the renewal date. You authorize us and our payment processors to charge your payment method for each renewal until you cancel.

You may cancel at any time from your account settings or by contacting us; cancellation takes effect at the end of the then-current billing period and you retain access until that date. We may change prices on renewal with reasonable advance notice. A free tier may be offered with limited functionality and no payment obligation; we may modify or discontinue the free tier at any time. Refunds are governed by our Refund Policy, which is incorporated into these Terms.

5. Third-Party Data and Services

The Service relies on public-record data and third-party providers, including the Free Law Project / CourtListener, PACER, payment processors, and hosting and analytics vendors. GavelSight is not affiliated with, endorsed by, or sponsored by the Free Law Project, the U.S. courts, PACER, or any other data source or competitor referenced in the Service. Third-party data is provided subject to the originating source’s terms, and your use of it must comply with those terms.

6. Intellectual Property

The Service, including its software, models, analytics, classifications, design, and content (excluding underlying public-record data), is owned by GavelSight and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal professional use during your subscription. You retain ownership of content you submit; you grant us a license to process it solely to provide and improve the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY ANALYTIC OR PREDICTION WILL BE ACCURATE OR RELIABLE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAVELSIGHT AND ITS MEMBERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST BUSINESS, LITIGATION OUTCOMES, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. You acknowledge that you do not rely on the Service as the sole basis for any legal decision and that these limitations are a fundamental basis of the bargain.

9. Indemnification

You will indemnify and hold harmless GavelSight from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

10. Term and Termination

These Terms apply while you use the Service. We may suspend or terminate your access for violation of these Terms or for conduct that risks harm to the Service or others. Upon termination, your license ends; sections that by their nature should survive (including Sections 6–9, 11, and 12) survive.

11. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Except for claims for injunctive relief relating to intellectual property, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Florida. You and GavelSight waive any right to a jury trial and agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding. You may opt out of this arbitration agreement by sending written notice to the contact below within 30 days of first accepting these Terms.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with an updated effective date and, where appropriate, communicated to account holders. Continued use of the Service after changes take effect constitutes acceptance.
